Duragarden Membership Terms

Effective Date: July 21th, 2026

By purchasing a Duragarden Membership, you agree to the terms below, which form part of Duragarden's general Terms of Service. Capitalized terms not defined here carry the same meaning given to them there.

What membership includes

Duragarden Membership is built to make owning a Duragarden simpler and more rewarding. Current benefits include, but aren't limited to:

  • Monthly credits, added to your account automatically on your membership anniversary and managed through your account. Credits can be redeemed for DuraPods, plant food, and other eligible consumables. Any rollover limit on unused credits is shown in your account.
  • Priority support, so membership questions and troubleshooting get handled first.
  • Member-only discounts on consumables, accessories, and future device purchases.
  • Free shipping on eligible orders placed through your membership.
  • Occasional surprise products, sent to active members from time to time.
  • Uninterrupted access to the Duragarden app, once it becomes available — membership will unlock its full feature set.

Duragarden may adjust these benefits at any time, without needing to justify the change or give advance notice. DuraPods, plant food, and accessories can be purchased individually, with or without membership; membership simply changes the price and how you pay for them (credits vs. checkout). Because DuraPods contain living material, some may not germinate or reach a full harvest despite our best efforts in selecting and testing them — this is a separate matter from membership itself and is handled under our Return & Replacement Policy.

Coverage and how billing works

A Membership is tied to your account and, where applicable, to a specific Duragarden device. The person who activated the Membership is the Membership Holder. You can hold more than one Membership if you own more than one device.

Plans and renewal. Membership is available as a monthly or annual plan. You're charged upfront for your first term. After that, your Membership renews automatically for another term of the same length — monthly renews monthly, annual renews annually — until you cancel. We'll charge whatever payment method we have on file at the price in effect at the time, plus any applicable taxes, without further notice beyond what the law requires. To avoid being charged for a new term, cancel before your current term ends; if you cancel, you keep your benefits through the end of the term you already paid for.

Promotions and offers

From time to time, Duragarden may run discounts or promotional offers tied to Membership. Read the specific terms of any offer carefully — they become part of these Membership Terms once you accept them. Unless stated otherwise in writing, paid discount offers are non-refundable. If we ever offer a free trial, it must be used within the stated window, and if you don't cancel before it ends, your account will convert automatically to a paid Membership under these Terms.

Your account

You can create an account by completing a purchase or by registering directly on our website or app. The information you give us — name, address, and payment details — needs to be accurate and kept current; you can update it any time from your account settings. Our Privacy Policy governs how we use this information. If your payment method is lost, stolen, or canceled, or if you suspect your account has been compromised, let us know right away.

Pausing, canceling, and what happens after

You can cancel at any time through your account on our website (and, once available, through the app), or manually by contacting us via email, chat, or our helpdesk. Canceling stops future renewals — you keep access through the end of your current billing period, without a prorated refund for the unused portion. Only monthly plans can be paused; both monthly and annual plans can be canceled outright.

If you cancel or pause, any remaining credits stay on your account for 90 days. Resume your Membership within that window and your credits are still there; after 90 days, unused credits are forfeited.

When Duragarden may suspend or end a Membership

We may suspend or terminate your Membership without notice if: your payment is overdue (we'll try to notify you first when reasonably possible); you gave us false or inaccurate information; you violate these Terms or our Terms of Service; you engage in conduct that breaks the law; or you're abusive, threatening, or harassing toward our team or other customers. If your Membership is suspended or ended this way, any related app or software access ends with it, and we may delete data tied to your account without further notice. You remain responsible for all charges up to the date of termination. Reinstating a terminated Membership may require paying a restoration fee on top of any outstanding balance.

Payment terms

By maintaining a Membership, you agree to pay the fee in effect for your plan, plus applicable taxes. If a charge would differ from what you originally authorized — beyond a straightforward tax change — we'll notify you of the new amount and date before charging it, unless the law requires something different. Charges may be batched and submitted together during or at the end of a billing cycle. Continuing to use your Membership after being notified of a change confirms your authorization for us to keep charging you.

Authorizing payment

When you add a payment method, you're confirming you're legally allowed to use it, and you authorize us — along with our payment processors — to charge it on a recurring basis for your Membership, or to place a hold for unpaid amounts. If a charge attempt fails, we may retry until the balance is settled; Duragarden isn't responsible for any fees your bank or card issuer charges you as a result of these attempts. If you provide a debit card, charges apply to it unless and until you add a credit card instead. Keep your payment details current — we'll ask you to update anything that's no longer valid.

Working with payment processors and financing partners

Purchases and Membership payments may run through third-party payment processors or financing partners, under whatever payment terms are shown to you at checkout. If you finance a purchase, you're also bound by the separate financing agreement you enter into with our financing partner — breaking those terms can be treated as a breach of these Membership Terms as well.

Billing questions and refunds

If you think you were billed incorrectly, contact us within 60 days of the billing date at support@duragarden.com. Outside of that 60-day window, we won't issue billing refunds or credits except where the law requires it.

Governing law

Duragarden is organized under the laws of the State of Wyoming, USA, and operates out of Florida; these Membership Terms are governed by Wyoming law, without regard to conflict-of-law rules, to the extent permitted by applicable law. Nothing here is meant to override any mandatory consumer-protection rights you may have under local law in the countries where Duragarden currently provides support and warranty service. As Duragarden's footprint grows to new countries, this section will be updated to reflect that.
